Family welcome guilty verdicts

The Te Puna family ‘viciously attacked' at their home two years ago are relieved those responsible have been held to account.

Two of the four originally on trial for being part of a group who turned up at the Duncan family's Te Puna Road home armed with spades and weapons in November 2012 were found guilty in Tauranga District Court yesterday.


Andrew and Linley, and their children, are glad to see the back of the courtroom this week.

Jack Simon Ake, 52, was found guilty of wounding with intent to injure and assault with a weapon on Andrew Duncan.

While Derek Michael Drewery, 27, was found guilty of assaulting Steven Peters, a friend of the Duncan family, during the fight.

The guilty verdicts were returned by a jury of 12 after a week-long trial.

The assault left Andrew Duncan with facial injuries, including a broken nose and swelling to his face, bruising to his body and a concussion after he was knocked unconscious with a spade.

Matthew Cooper, a friend of the family, was attacked with a spade and sustained arm injuries as a result.

Speaking to SunLive today, Andrew Duncan says the family are pleased to 'finally see some justice done” after waiting almost two years.

'This has been a very harrowing week for all of our family and friends but we are glad to have had our day in court and face some of the individuals that endangered our lives that night, without cause and with absolutely no conscience or thought to their actions.

'Given the large number of people that took part in the extremely violent attack on us that night, it is disappointing that so few were ever called to justice, and that the viciousness and intent of their actions was in some cases greatly diluted.”

Andrew says the prosecution team did a great job in achieving what justice they could from the situation before them.

'We are very grateful to the jury for their close attention and unanimous verdicts. We feel this and the judge's comments show our community is totally sick of the mindless violent acts of a few.

'From a personal perspective this whole episode has exacted a very heavy toll on all of us who were involved on the night, and our extended family.

'Both Linley and I are extremely proud of the actions of our sons and their friends on that horrific night, and throughout the stressful days of this trial.

'We are also very grateful for the support and guidance of Detective Logan Nicholas, and Victim Support.”

Part way through the trial Jasmine Hira Borrell, 26, pleaded guilty to two counts of assault and was remanded on bail for sentencing.

Meanwhile a fourth person – Rihari Jarrod Borrell, 23, - was discharged on all charges due to lack of evidence and was released.

Sentencing is due to take place on October 14.

Ive known Andrew for a great many years,He and his family are the very best of people,In my opinion very little justice has been done, the low life that attacked him and his family are nothing less then a waste of space!!! Wish you Andrew and your family the very best from here on :)
