Council seeks $800,000

An unpaid contractor wants to know why the mediation over the Lynley Park sub division at Omokoroa has been stalled for three years.

The council is seeking $800,000 from the developers for what it alleges is substandard sewerage and stormwater piping.
Russell denies fault. Pemberton Holdings 2006 Ltd is an ISO certificated company and he has provided all his supporting documentation concerning the job.
The bedding used was onsite ash, which is the accepted methodology and construction technique used in the Bay of Plenty and other areas when the pipes were installed, says Russell.
The council lodged its statement of claim over the pipes in May 2008, after it had approved the work by issuing a 224c certificate of compliance, in spite of there being no objections raised during inspections throughout the construction phase, says Russell.
'They want to beat everybody up, but they don't want to address the situation in their own systems, the out of date standards in the Western Bay of Plenty District Council's code of practice,”
says Russell.
'They are going round and round in circles, but they can't find the goods to have the fight with. We did our job exceeding minimum standards and met the requirements.
'They've had five years use and rates revenue from this development, that's 10 per cent of the project life gone already. They are wasting ratepayers' money.”
Russell has lodged a complaint with the ombudsman, and is considering legal action against the developers.
