The majority of Tauranga City Council's elected members voted to fight a request for a judicial review into the sale of the Tauranga marine precinct, minutes from a closed-door meeting in February show.
Mayor Mahé Drysdale, deputy mayor Jen Scoular, and councillors Hautapu Baker, Marten Rozeboom, Kevin Schuler and Rod Taylor also directed the council to oppose efforts from marine precinct users to prevent the council from selling the land to developer Sam Rofe.
These votes seem at odds with ongoing comments from Drysdale to RNZ that he didn’t like the sale and would like to get out of the deal.
Marine precinct user Pacific 7 was granted an interim injunction stopping the sale last year after serving the council with a judicial review.
The case went before the High Court at Tauranga on February 25 where Justice Andrew reserved his decision.
When asked in March what role the council was playing in the hearing, Drysdale told RNZ it was not fighting the injunction.
“As Tauranga City Council, we are a party and obviously provided information that was required to that, but we weren’t actually a party to the strike out of that injunction,” he said at the time.
The minutes of the public-excluded council meeting on February 10 appear to tell a different story.

MP for Tauranga Sam Uffindell said he asked for the minutes to be made public after reading the statement by Drysdale to RNZ that the council “were not the ones fighting the injunction”.
“This didn’t appear consistent with what I saw in court, where [council’s] legal team appeared to be actively fighting the injunction,” he said.
He said he wants accountability, transparency and value for ratepayers in Tauranga.
“Some of the public statements appear inconsistent with reality, and this is concerning. Trust and integrity of process are essential in a healthy democracy.”
However, Drysdale told RNZ that while he might not like the commercial terms of the deal, he voted in support of the motions to fight the judicial review and injunction as the majority of elected members believed that would deliver the best outcome for the people of Tauranga.
“The judicial review before the courts alleges that the commissioners made legal errors prior to and in entering into the marine precinct sale contract. Since the litigation was filed, our council has had the opportunity to receive an officer’s report and legal advice,” he said.
He said he continues to stand by his claim that he opposes the sale.
“Throughout this process, I have been open and transparent that this deal is not one I would have voted for had it come before the current council.”
Councillor Glen Crowther, Rick Curach and Steve Morris voted against both resolutions.
Crowther did not want to comment on whether the mayor’s statement in March was misleading, but he said it was clear at the meeting that voting for the resolutions was because the council wanted to push ahead with the sale.
“I understand [the resolution] means … that the council opposed Pacific 7’s application for an interim injunction in February, which if successful would continue to stop the sale from proceeding until the matter is legally resolved,” he said.
Crowther said his position on the sale has been clear since a meeting in October, when he proposed a vote amendment indicating that the sale may have breached the council’s own policies.
He said he wants the council to be transparent with the community about the issue. However, councillors have received legal advice to not make public statements while the matter is before the court, even if the comments would clarify the council’s position.
“Hence, to my knowledge, only the mayor has made public comments up to now. I am only commenting now on these particular aspects because this information has just been made public,” he said.

I think it's important to understand the context.
Mayor Mahé Drysdale and elected members, from the outset of their appointment, have stated quite clearly, their focus will be on the very best outcomes for the community, on building positive relationships and trust with the community. They at best misled, bu it would appear, chose to lie.
Our elected members by majority have however demonstrated through their actual decision-making and outcomes that they have very much the CEO and senior management team as their focus, and dare I say it, the ambitions of the Urban Task Force.
An absolute disgrace, not just Mayor Mahé Drysdale, but the majority of elected members. The elected members attempt to justify their decision by saying they have had reports from staff and legal opinions sought by staff. That in itself clearly identifies the issue a number of us have picked up on from the outset of their appointment, specifically, totally reliant on and in bed with staff and local influences.
As a community we have been well and truly duped, misled and lied to from the outset, and that would be since the appointment of the commissioners until today and no doubt beyond. 😥
It is glaringly obvious why the elected members code of conduct, according to the policy put in place by the elected members, cannot be used by members of the community because if ever there was a case for bringing the role of Mayor or councilor into disrepute, this would have to be it.

There have been many calls in the comments section of the sunlive posts wanting a significant shake-up in the unelected offices, and I strongly suspect that the advice being given to very recently elected councillors is probably unsound.
The only people with genuine insight into the unfettered spending of the unelected commissioners are behind the closed doors of council offices. In other words, I suspect that we are seeing a significant effort going into protecting people and council operations from potential accusations of corruption. We have already seen the screens going up, with any suggestions of naming names censored and statements from the mayor, protecting those in prominent positions.
We need a proper enquiry into our council offices. FROM THE TOP DOWN.

So bad decision for sell under valuation and then spend a lot more defending a bad deal that absolutely needs to be challenged. How out of touch can they be. Still no cost cutting on anything , unaffordable nice to haves projects structural changes .

I think this council are a huge disappointment being led by the nose by staff bureaucrats . Seems changing elected members changes nothing a deeper in debt and double digit rate rises will be the result. No wonder voting and confidence in lot is low and getting lower. I agree with Murray but it tells me nothing has changed since the spend a run commissioners

I’m pretty sure that most, if not all, of our council were elected fot their position on the Commission. To backtrack on that is vey badly immoral.
My own hope was that the City Centre works would be paused and completed over a period of five years or so. I get that some of the work has been committed to by Council staff and can’t be stopped, but now that no one trusts the word of Council, we will never know the truth.
The sale of the Marine Precinct was one of the more stupid decisions to come from the Commission and I’m surprised that we are fighting the injunction. Throwing good money after bad!

I totally agree with Murray Guy. I wrote as a pensioner on a fixed income to our Mayor Mahe Drysdale. I explained that the council rates were projected to rise by 12% at the time that the pension has been increased by 3%. He did reply to me but from a position of privilege with no understanding of how pensioners on fixed incomes are expected to be able to pay for council rates which will probably double each 4 years. It will probably take the pension up to 15 years to double. There is a startling discrepancy between the two. We are now at the point of being driven out of our homes because of the lack of understanding or concern by councilors of our plight.

There is a complete & total lack of transparency from TCC regarding the sale of the Marine Precinct.
Not only is this deal putting good hard-working people out of their jobs & businesses, but it's also an extremely bad deal for ratepayers too.
The developer has received the deal of a century, purchasing land millions of dollars under market valuation & then also receiving a further $30m of ratepayer's money too!!
Cynically, it would not surprise me one bit if this developer decides to on sell the land to be developed for a hotel & conference centre.
TCC have an option to back out of this deal but have decided not to. So TCC why not be transparent with your ratepayers rather than having meetings behind closed doors & let us all know what the real agenda of this sale is for.

I look forward to hearing from the current city councillors on their thoughts and understanding of this issue.
I strongly suspect that one or two of them have put absolutely no thought into their position on the actions of previous incumbents and this will lead me to have no faith in their ability to work for ratepayers now or into the future.
Once again we need to have a very intense investigation into the management process for the fifth largest city in the country.
We obviously need to demand BINDING referenda for projects with a significant value and we probably require a judicial review of council activities in the last ten years.
THIS IS JUST NOT GOOD ENOUGH.
Unsettling Pattern

There is becoming a very unsettling pattern with this council that what we are told about their activities turns out to be totally false. This is not the first time that the mayor has been caught out deceiving us, but now we see that a large chunk of the councilors are doing the same. Remember all of the promises of openness and transparency?, well forget them, they were fake. Why should any council need to operate "closed door" meetings? Every time that there is one, we belatedly find out that it was in order to do something that they knew the ratepayers would oppose, so they shut the ratepayers out. No more closed meetings, they are supposed to be public meetings of our elected representatives, why should they need to do anything in secret, unless it is intended to deceive? And deceive they have
