Robbery accused back in court

A Tauranga woman facing charges over the aggravated robbery of Brookfield Veterinary Centre is planning to defend them at trial after a lapse in communication saw her fail to appear in court.

Cathy Anne Davies, 33, is facing one charge of aggravated robbery in relation to the robbery at the Otumoetai Road centre in June this year.

Davies was due to appear in court last Thursday but never showed up. A warrant for her arrest was issued until she made a voluntary appearance on Friday where she was granted bail.

When she appeared in Tauranga District Court yesterday her lawyer Craig Tuck says she did not show up at court as there was a miscommunication between her and the probation officer and she was given the wrong date.

Crown prosecutor Hayley Sheridan accepted the statement and did not oppose continued bail.

Judge Robert Wolff remanded Davies on bail until February 13, 2014 for a judicial conference ahead of the trial.

Davies co-accused Lucy Jane Kellick, 26, and Colin Thomas Borthwick, 23, have both been convicted and sentenced for the robbery. Kellick was jailed for three and half years and Borthwick for two years and nine months.

On July 25 Borthwick entered the vets on Otumoetai Rd wearing a balaclava and armed with a carving knife.

According to court documents he and a woman, who was also disguised and carrying a baton, approached the counter about 5.20pm. A lone female worker was in the backroom of the vet centre when the pair appeared demanding cash and drugs.

The female worker was forced to put $250 in a plastic bag, along with drugs used at the practice, before the pair fled to a waiting vehicle driven by a third person.

Police then stopped the car a short time later down on Bureta Road and arrested Borthwick, Kellick and one other woman.
